  1. A permit holder shall submit to the Director for approval its screening methodology for preventing prohibited individuals from utilizing its platform and shall notify the Director before making any changes to its methodology.

GLI recommends splitting Minors and Prohibited Players from 11 VAC 5-70-210 and merging in 11 VAC 5-80-70 which has similar intent and adding updates reflective of § 58.1-4041

  1. A permit holder shall confidentially maintain the list provided by the Director of prohibited individuals and prevent them from placing wagers with the permit holder. A permit holder shall maintain a system approved by the Director through which the permit holder verifies that wagers are not placed by such prohibited individuals.

§ 58.1-4041

  1. No Director, Board member, officer, or employee of the Department, nor any officer or employee of any entity working directly on a contract with the Department related to sports betting, shall make a wager on any sports betting platform of any permit holder, nor shall such person make a wager through another person as a proxy.

§ 58.1-4041

  1. Any permit holder, or director, officer, owner, or employee of a permit holder and any relative living in the same household as such persons shall be prohibited from sports betting only with respect to the related permit holder, nor shall such individual place a wager through another person as a proxy. Such individual shall not be prohibited from placing sports bets with other permit holders.

§ 58.1-4041

  1. Any competitor, coach, trainer, employee, or owner of a team in a professional or college sports event, any referee for a professional or college sports event, or any other covered person shall be prohibited from placing a bet on any event in a league in which such person participates, nor shall such individual place a wager through another person as a proxy or to provide material non-public or confidential information regarding such competition to any sports bettor before such information is made public. In determining which persons are prohibited from placing wagers under this subsection, a permit holder shall use publicly available information and any lists of persons that a sports governing body provides to the Department.

11 VAC 5-80-70.A

  1. A permit holder shall take such actions and establish such procedures as may be necessary to identify and report to the Department any activity prohibited by this subsection and Article 2, Chapter 40 (§ 58.1-4041) of Title 58.1 of the Code of Virginia. Such actions and procedures include, but are not limited to:
    1. Making known to all affected individuals and corporate entities the prohibition against disclosure of proprietary or material non-public or confidential information that may affect sports betting or the outcome of sports betting to any individual permitted to participate in sports betting; and
    2. Making commercially reasonable efforts to obtain lists of individuals prohibited by the sports betting law from participating in sports betting for the purpose of monitoring for and excluding such individuals from platforms operated by the permit holder

11 VAC 5-80-70.B

  1. A permit holder, upon learning of a violation of this subsection and Article 2, Chapter 40 (§ 58.1-4041) of Title 58.1 of the Code of Virginia, shall immediately bar an individual committing the violation from participating in, or disclosing proprietary or material non-public or confidential information about, sports betting by:
    1. Banning the individual committing the violation or disclosing or receiving prohibited information, from all platforms operated by the permit holder;
    2. Terminating any existing promotional agreements with the individual; and
    3. Unsupported image type.Refusing to make any new promotional agreements that compensate the individual.

11 VAC 5-70-210.F

  1. A permit holder shall prohibit an individual who is barred by the sports betting law from placing a wager on a sporting event from collecting payouts or winnings from its sports betting operation.
