In accordance with Virginia law, the petition will be filed with the Register of Regulations and published on December 21, 2020 with comment requested until January 20, 2021. It will also be placed on the Virginia Regulatory Townhall and available for comments to be posted electronically at www.townhall.virginia.gov.
At its first meeting following the close of comment, which is scheduled for February 5, 2021, the Board will consider the request to amend regulations and all comment received in support or opposition. The petitioner will be informed of the board’s response and any action it approves.

Agency Decision Summary |
The Board considered the petition at its meeting on February 5, 2021 and decided it would not initiate rulemaking. An applicant from another state can qualify by meeting the education and experience requirements for licensure. In lieu of meeting those requirements, the Board allows an applicant to verify two years of post-licensure clinical practice as a minimum to demonstrate competency. The Board recently reviewed its regulations for endorsement and determined that the requirement for some period of clinical practice for those applicants who do not qualify by education and experience is necessary to protect the public health and safety |
