Agency's Plan | The petition will be published on October 16, 2017 in the Register of Regulations and also posted on the Virginia Regulatory Townhall at www.townhall.virginia.gov to receive public comment ending November15, 2017. Following receipt of all comments on the petition to amend regulations, the Board will decide whether to make any changes to the regulatory language. This matter will be on the Board’s agenda for its first meeting after the comment period, which is scheduled for February 8, 2018. |

Agency Decision Summary | The petition and the comments on the petition were considered by the Board at its meeting on Friday, March 15, 2018. Members of the Board voted to deny the petition because they believe delegation of administration of Schedule II through V drugs to unlicensed assistants is not consistent with protection of public health and safety. There is no measure of competency and no direct accountability for practice by an unlicensed person. Additionally, there does not appear to be any authority in the Virginia Drug Control Act for such delegation of administration of controlled substances. |
