Petitioner's Request | To amend section 18VAC140-20-50, relating to requirements for supervision to clarify the status of an individual who has completed supervision but has not passed the examination for LCSW licensure. Such individual should not be in the status of a "supervisee in social work" and should be exempt from providing information to his previous clinical supervisor. |

The petition was filed with the Register of Regulations and will be published on October 24, 2011 with a request for comment to be received until November 15, 2011. The petition will also be posted for comment on the Virginia Regulatory Townhall at www.townhall.virginia.gov
At the next meeting held after the close of the comment period, the Board will consider the petition and any comment received to decide whether or not to initiate the rule-making process. |

Agency Decision Summary | At its meeting on January 20, 2012, the Board considered the petition and decided not to initiate the rule-making process. Since the law in Virginia requires licensure for a clinical social worker, a person who has completed the requisite number of supervised hours but has not passed the examination and been issued a license may not engage in practice except as a supervisee under supervision or in an exempt setting. Regulations of the Board cannot be in conflict with the Code of Virginia. |
