Section 18 VAC 145-30-80 (Waiver from examination) of the proposed final regulations provides for granting a certificate without examination to applicants who hold an unexpired profession wetland delineator certification including those provisionally certified under the U.S. Army Corps of Engineers Wetland Delineator Cerification Program of 1993. Please note that the certifications that were granted by the Corps in 1993 have a note at the bottom of the certificates indicating that the provisional certification expires in March 1994. Therefore, no one provisionally certified in 1993 through the Corps' program would have an unexpired certification. I will fax a copy of my certification to Mark Courtney as an example for the record. It is my understanding that the Corps had intended to grant regular certifications to those provisionally certified when the program was up and running. However, implementation of the program was indefinitely delayed. DPOR should address how this expiration note at the bottom of the 1993 certificates will be regarded when submitted by prospective applicants and whether the provisional certifications would be accepted notwithstanding this expiration note.
