11 VAC 5-60-20 Request for Voluntary Exclusion

GLI Recommendations

H.   For Internet online voluntary self-exclusion submissions: The Virginia Lottery website Internet gaming system shall provide a link within the player’s Internet gaming account directly to a Internet voluntary self-exclusion application form and provide to the voluntarily self-excluding individual for his or her acknowledgment of the following statement: “I am voluntarily requesting exclusion from all forms of legalized gaming in the Commonwealth Virginia Internet gaming until such time as the Department removes my name from the voluntary exclusion list in response to my request to terminate my voluntary exclusion. In addition, I also understand that the Department will share my information will be shared with the Department of Agriculture and Consumer Services, the Office of Charitable and Regulatory Programs and the Virginia Racing Commission, who may prohibit me from participating in further gaming activities regulated by those entities. I certify that the information I have provided is true and accurate, and that I have read and understand and agree to the waiver and release included with this request for Internet voluntary self-exclusion. I am aware that my digital signature authorizes the Department to prohibit me from participating in all account-based lottery games gaming activities regulated the Board and to direct all permit holders of sports betting permits in Virginia to restrict my gaming activities. I am further aware that my digital signature authorizes the Department to share my information with the Department of Agriculture and Consumer Services, the Office of Charitable and Regulatory Programs and the Virginia Racing Commission, who may further restrict my gaming activities. In accordance with this request and until such time as the Department removes my name from the voluntary self-exclusion list in response to my request to terminate my voluntary self-exclusion, I am aware and agree that during any period of voluntary self-exclusion any money or thing of value obtained by me in violation of the terms of my voluntary self-exclusion shall be subject to forfeiture and donated to the Commonwealth’s Problem Gambling Treatment and Support Fund.”

As the voluntary exclusion list is controlled by the Board, GLI recommends this requirement indicate initial responsibility of the application form to the Board. Further linking from the sports betting platform will be addressed in their regulations.

GLI also recommends adding “the Department of Agriculture and Consumer Services,” since fantasy contests, as mentioned in § 58.1-4015.1, are regulated by them.

H.   For in person life-time voluntary self-exclusion submissions: The request shall be delivered to Department headquarters or any other location specified by the Department including the signature of the individual submitting the request indicating acknowledgment of the following statement: “I am voluntarily requesting exclusion from all forms of legalized gaming in the Commonwealth until such time as the Department removes my name from the voluntary exclusion list in response to my request to terminate my voluntary exclusion. account-based lottery games and sports betting activities offered by any holder of a sports betting permit in Virginia. In addition, I understand that my information will be shared with the Department of Agriculture and Consumer Services, the Office of Charitable and Regulatory Programs and the Virginia Racing Commission who may prohibit me from participating in further gaming activities regulated by those entities. I certify that the information I have provided above is true and accurate, and that I have read and understand and agree to the waiver and release included with this request for voluntary self-exclusion. I am aware that my signature below authorizes the Department to prohibit me from participating in all account-based lottery games gaming activities regulated by the Board and to direct all permit holders of sports betting permits in Virginia to restrict my gaming activities. I am further aware that my signature authorizes the Department to share my information with the Department of Agriculture and Consumer Services, the Office of Charitable and Regulatory Programs and the Virginia Racing Commission who may further restrict my gaming activities. GLI recommends merging clauses with similar intent and adding “the Department of Agriculture and Consumer Services,” since fantasy contests, as mentioned in § 58.1-4015.1, are regulated by them.

J.     Any individual submitting a voluntary exclusion request for life shall be required to present valid identification credentials containing his or her signature and either a photograph or a general physical description. Any individual requesting voluntary exclusion for life pursuant to this subchapter may be required to have his or her photograph taken by the Department upon submission of the request. The Department shall document the type of identification credentials that were examined containing the signature of the individual requesting life-time voluntary exclusion, and whether said credentials included a photograph or general physical description of the individual.

GLI recommends merging in last two sentences from 11 VAC 5-60-20.C

J.     A Department employee authorized to accept a voluntary self-exclusion request shall sign the application form and confirm that the signature of the individual on the request for life-time voluntary self-exclusion appears to agree with that contained on his or her identification credentials and that any photograph or physical description of the individual appears to agree with his or her actual appearance.

 

L.    The Department shall confirm the individual's request to be placed on the life-time voluntary self-exclusion list.
