11 VAC 5-60-50 Removal from Voluntary Exclusion List

GLI Recommendations

  1. Except for those individuals choosing a lifetime voluntary self-exclusion, any self-excluded individual may, upon the expiration of the period of voluntary self-exclusion requested pursuant to 11 VAC 5-60-20, request removal of his or her name from the voluntary self-exclusion list by submitting, online or in person, a completed request for removal as required in B. below. The request shall be delivered to Department headquarters or to such other location as may be specified by the Department. Any individual submitting a request for removal from the list in person shall be required to present valid identification credentials containing his or her signature and either a photograph or a general physical description.

GLI recommends allowance of online requests for removal.

  1. A request for removal from the voluntary self-exclusion list shall be in a form prescribed by the Department, which form shall include:
    1. The identifying information specified in 11 VAC 5-60-20;
    2. The signature of the individual requesting removal from the voluntary self-exclusion list, indicating acknowledgment of the following statement: “I certify that the information that I have provided above is true and accurate. I am aware that my signature below constitutes a revocation of my previous request for voluntary self-exclusion, and I authorize the Department to permit all Virginia sports betting permit holders as well as the Department of Agriculture and Consumer Services, the Office of Charitable and Regulatory Programs and the Virginia Racing Commission to reinstate my gaming privileges.”;
    3. The type of identification credentials examined containing the signature of the individual requesting removal from the voluntary self-exclusion list; and
    4. The signature of a Department employee authorized to accept such request, indicating that the signature of the individual on the request for removal from the voluntary self-exclusion list appears to agree with that contained on his or her identification credentials.
  2. The Department shall, by the end of the fifth business day following receipt of the request, delete the name of the individual requesting removal from the voluntary self-exclusion list and notify each sports betting permit holder, the Department of Agriculture and Consumer Services, the Office of Charitable and Regulatory Programs, and the Virginia Racing Commission of such removal by transmitting a notice directly to each.

GLI recommends adding “the Department of Agriculture and Consumer Services,” since fantasy contests, as mentioned in § 58.1-4015.1, are regulated by them.
