11 VAC 5-60-10 Definitions

GLI Recommendations

• "Voluntary exclusion program" means a program established by the Board pursuant to § 58.1-4103 that allows individuals to voluntarily exclude themselves from engaging in the activities described in subdivision B 1 of § 58.1-4103 of the Code of Virginia by placing their names on a voluntary exclusion list and following the procedures set forth by the Board.

GLI recommends adding in definition of “voluntary exclusion program” from § 58.1-4002.

• “Voluntary Self-exclusion list” means a list of names of individuals who, pursuant to this subchapter, have voluntarily agreed to refrain from the activities described in subdivision B 1 of § 58.1-4103 of the Code of Virginia of the Code of Virginia

1. playing any account-based lottery game authorized under the provisions of the Virginia Lottery Law;
2. participating in sports betting, as defined in § 58.1-4030 of the Code of Virginia; and
3. participating in gaming activities administered by the Office of Charitable and Regulatory Programs or the Virginia Racing Commission.

Self-excluded individuals whose names are on the self-exclusion list are prohibited from collecting any winnings or recovering any losses resulting from violation of the restrictions to which such individuals have agreed.

GLI recommends overall change from “self-exclusion” to “voluntary exclusion” throughout 11 VAC 5-60 to be consistent with what is laid out in § 58.1-4103.

GLI also recommends moving the last sentence of the definition to 11 VAC 5-60-20.E

• “Involuntary exclusion list” means a list of names of individuals who, pursuant to this subchapter, are to be excluded from the activities described in subdivision B 1 of § 58.1-4103 of the Code of Virginia.
• “Self-Excluded individual” means any individual whose name is included on the involuntary exclusion list, or at his or her own request, on the voluntary self-exclusion list maintained by the Department.

GLI recommends addition of Involuntary exclusion list based on what has been seen in other markets.

• “Permit holder” means a person who has been issued a permit to operate any gaming activities regulated by the Board

GLI recommends adding definition to cover all forms of gaming regulated by the Board.
