§18.2-76.B. in the Code of Virginia states that "a qualified medical professional trained in sonography and working under the supervision of a physician licensed in the Commonwealth shall perform fetal transabdominal ultrasound imaging on the patient undergoing the abortion for the purpose of determining gestational age."

 

12VAC5-412-230.A. of the abortion regulations, both originally and as amended by the BOH, are in line with the Code of Virginia.

 

However, the Governor's recommended amendments of 12VAC5-412-230(A) remove the requirement that a "licensed physician" determine the gestational age as required by the Code of Virginia, and replaces it with "licensed health care provider."

 

Retain the original language, or the language as amended by the Board. The abortion facility regulations must follow the law.
