I am an individual on the FIS who currently receives 16 hours per day of personal care hours. I do not feel safe being left alone. I cannot drive, I require assistance to use DME and would help 24/7 in the event of an emergency. DMAS needs to provide clear guidance on what evidence is required to override the soft cap. I am also worried that allowing CDCN to do the paperwork regarding the wavier would eliminate the checks and balances in the system. Lastly I am concerned that allowing a public comment period on issues like this before fully explaining the changes to the interested individuals is a violation of due process. Can someone from the state contact me and explain how to get around the soft cap what are the appeal process and rights going to be and who will review the request? How long will appeals take to process?
