The Department of Environmental Quality (DEQ) has prepared a Statement of Basis (SB) on its proposed remedy for the former DC Corrections (Lorton Correctional Facility) (hereinafter referred to as the Site or the Facility) located at 8515 Silverbrook Road Lorton, Virginia.

The Facility is subject to the Corrective Action program under the Solid Waste Disposal Act, as amended by the Resource Conservation and Recovery Act (RCRA) of 1976, and the Hazardous and Solid Waste Amendments (HSWA) of 1984, 42 U.S.C. §§ 6901 et seq. (Corrective Action Program). The Corrective Action Program is designed to ensure that certain facilities subject to RCRA have investigated and cleaned up any releases of hazardous waste and hazardous constituents that have occurred at their respective facilities. For this Facility, the DEQ retains primary authority in Virginia for the Corrective Action Program. DEQ has prepared this SB in cooperation with the United States Environmental Protection Agency (EPA). The Administrative Record (AR) for the Facility contains all documents, including data and quality assurance information.

DEQ’s proposed remedy for the Facility consists of land use controls in the form of institutional controls. This SB highlights key information relied upon by DEQ in making its proposed decision.

Before DEQ makes a final decision on its proposal for the Facility, the public may participate in the remedy selection process by reviewing this SB and documents contained in the AR for the Facility. The AR contains all information considered by DEQ in reaching this proposed decision. The Administrative Record, including the SB, is available for review during normal business hours by contacting the staff contact listed below.

Interested parties are encouraged to review the AR and comment on DEQ’s proposed remedy. The public comment period closes on July 16, 2018. You may submit comments by mail, fax, or e-mail to the staff contact listed below.

DEQ will hold a public meeting to discuss this proposed remedy upon request, which should also be made to the staff contact listed below. DEQ will respond to all relevant comments received during the comment period. If DEQ determines that new information warrants a modification to the proposed remedy, DEQ will modify the proposed remedy or select other alternatives based on such new information and/or public comments. DEQ will announce its final remedy and explain the rationale for any changes in a document entitled the Final Decision and Response to Comments (FDRTC).
