Regulations Governing the Licensure of Pharmacists and Registration of Pharmacy Technicians
[18 VAC 110 ‑ 21]
Emergency Extension Request
(6070)
Action:
(9778)
Stage:
On 4/16/2024 the board requested that this
emergency stage be extended until 2/19/2025.
Reason for Extension:
Chapters 790 and 791 of the 2022 Acts of Assembly required the Board of Pharmacy to promulgate emergency regulations regarding pharmacists initiating treatment, building on legislation from the 2020 and 2021 sessions allowing pharmacists to initiate treatment. Emergency regulations became effective on February 21, 2023 and are currently set to expire on August 20, 2024. The Board submitted proposed regulations to replace the emergency regulations on June 21, 2023. The Governor approved those proposed regulations on April 1, 2024 and will be published by the Registrar on April 22, 2024. The public comment period will run from April 22 to June 21, 2024. Although the Board intends to vote on final regulations at its June 25, 2024 meeting despite the short time frame between the close of public comment and the scheduled meeting, it is not possible for final regulations to complete executive branch review, be published, and become effective 30 days after publication prior to the current expiration date of August 20, 2024. The agency requests a six-month extension of the emergency regulations to ensure public health service coverage for diseases and conditions addressed by the 2022 legislation.
This emergency extension request was approved by the Governor's office on 4/23/2024.
