Proposed 8VAC20-781-70(B) would require that staff maintain a list of children that accurately reflects the children in their care. While reasonable on its face, this regulation is vague, subject to a variety of interpretations, and impractical. If the facility requires parents to check their child in/out, does this constitute staff maintaining a list? If so, what happens when a parent forgets to do so? Is staff responsible for constantly verifying that parents have performed their duty? Staff's focus should be on looking after the children, not the parents. Also, how is "accurately reflects" assessed? Accurate as of the beginning of the day? Accurate as to every minute of every day? When a staff member is engaged with children and a parent picks up their child, is the staff member expected to immediately leave the children in order double-check that the parent followed the sign-out procedure?
