The Biden administration is proposing changes to the asylum process that critics contend would — in the name of administrative efficiency — circumvent current immigration law and sharply increase the numbers of illegal immigrants granted asylum, even as the U.S. is on track to receive more than two million illegal immigrants this year.
The changes are considered "a key step toward implementing the administration's blueprint for a fair, orderly, and humane immigration system," the U.S. Citizenship and Immigration Services (USCIS) said in a statement.
The Department of Homeland Security and Department of Justice published a 140-page notice of proposed rulemaking outlining how current regulations would be changed. The major change is suggesting that USCIS asylum officers solely decide asylum applications instead of immigration judges in an effort to "more promptly and efficiently consider the asylum claims of individuals encountered at or near the border, while ensuring fundamental fairness," DHS Secretary Alejandro N. Mayorkas said. "Individuals who are eligible will receive relief more swiftly, while those who are not eligible will be expeditiously removed. We are building an immigration system that is designed to ensure due process, respect human dignity, and promote equity."
The proposed rule is part of an overall strategy of the administration to expand "pathways to apply for protection and opportunity in home countries, addressing the root causes of migration, and securely managing the Southwest border," USCIS says.
Officers would have unilateral power to approve applications for asylum, withhold individuals from deportation, and oversee claims related to the Convention Against Torture. If an officer were to deny an application, there are up to six ways to appeal, including to the U.S. Supreme Court.
There is currently a backlog of 1.3 million cases, with approximately 610,000 pending asylum applications and 539 immigration judges as of April 2021, the proposal states. The median completion time for cases involving individuals who were detained through the 2nd quarter of FY 2021 was 43 days. The recent average case completion for non-detained individuals in removal proceedings in immigration court is roughly 3.75 years, the administration states.
With the influx of illegal immigration at the border, the backlog has ballooned, and the administration estimates "it will need to hire approximately 800 new employees and spend approximately $180 million to fully implement the proposed asylum officer hearing and adjudication process to handle approximately 75,000 cases annually."
In fiscal year (FY) 2020, asylum officers affirmed nearly 79,000 asylum cases, Doris Meissner senior fellow at the Migration Policy Institute, notes.
The proposed changes are "potentially a game changer," she argues. "Because it is being done through a regulation — the strongest legal footing to enact policy change short of legislation — its implementation cannot be immediate, due to the required public comment period before issuing a final rule."
The regulatory change would facilitate a major change to immigration policy without going through Congress, argues Federation for American Immigration Reform spokesperson Matthew Tragesser.
The proposal allows asylum officers "to quickly approve requests for asylum and other forms of humanitarian protections to aliens who illegally cross the border and release aliens subject to mandatory detention into the interior of the United States, contrary to statute," told Just The News.
The proposed rule changes came from "research and recommendations the Migration Policy Institute made in a 2018 report as a policy solution to make border case management more effective and timely," Meissner says. "Under the new policy, asylum seekers found to merit protection will not be kept in limbo for years at a time while awaiting a final status determination."
But these changes don't "deter illegal immigration or discourage fraudulent asylum claims," Tragesser argues. "In fact, this proposal may only encourage more illegal immigration and fraud, as it will weaken the credible fear review process, resulting in a higher rate of aliens with meritless claims receiving protection from deportation."

The political team at the White House thought they hit political pay dirt with the new Biden vaccine mandate on private employers. Not so much. Less than two weeks after an already abbreviated period of time for the public to review and comment on the proposed regulatory change, Biden’s Department of Health and Human Services finalized a regulation that violates the clear language of Obamacare in order to benefit Planned Parenthood and other corporate abortion interests. The leaked document, dated August 10 and more than 300 pages long, was then sent to the Office of Management and Budget for final approval, according to multiple sources familiar with the federal rule making process. OMB posted confirmation of receipt August 19, a mere 50 days after the major rule change was first proposed to the public.
“In their rush to finalize the rule, HHS and [Secretary Xavier] Becerra are making a mockery of the rule making process. Their efforts to minimize public input and provide only cursory review shows the rule was predetermined,” said Rachel Morrison, a policy analyst at the Ethics & Public Policy Center who submitted comments opposing the rule.

When it comes to non-pharmacologic interventions such as mandatory business closures, mask mandates, and countless other interventions, the shocking conclusion of the last 18 months is this: We have learned next to nothing.
Yet, here we are again with CDC changing its mind on masking, but what new evidence is guiding the policy?
While CDC said vaccinated people with breakthrough infections from the Delta variant carry viral loads similar to the unvaccinated, they haven't yet shared any data on this, and this also doesn't negate the need for sufficient research into how and when mask mandates are effective. And no, I am not here to say that masking can't be an effective public health intervention. It may be, and people should mask-up when their local leaders tell them to. Instead, I am here to call attention to the need for evidence-driven policy.
Anyone who considers themselves a scientist should be embarrassed by our collective failure to generate knowledge, and this failure is once again looming large. The CDC is again recommending vaccinated people to wear cloth masks in indoor public spaces, at least in locations where COVID is surging. The CDC director calls this "following the science," but it is not. It is following the TV pundits.
Many studies have documented the flow of particles in and around masks, and countless studies have examined the differences between locations that implemented mask mandates and locations that did not. While this information is interesting, it is often conflicting, and worse, does not offer a sufficient basis for public health recommendations. Mechanistic studies are incapable of anticipating and tallying the effects that emerge when real people are asked to do real things in the real world.
Comparing places that implemented restrictions to those that did not is a fool's errand. The confounding variables abound: political valence, pre-intervention trends, other behavioral changes, and a host of other differences that are not easily adjusted for.
The CDC's guidance applies only to substantial and high transmission counties (50 daily cases or higher per 100,000 people), but again, there is no science that shows mandates work in these settings but not others. It is also a confusing and constantly changing metric to try to keep track of.
Israel — one of the most vaccinated countries in the world (60%) — is experiencing a surge in new Covid-19 infections. The observation is suggestive, not definitive, but there are two ways to think about it:
Natural immunity is more robust than the immunity conferred by the current crop of vaccines.
The vaccines Israel is using “invite� infection by one or more of the newer virus variants.
Or, more simply, the vaccinated population has become a “safe place� for the virus to live and continue mutating.

And Israel has one of the most vaccinated populations in the world. About 60% of the nation’s entire population of 9.3 million has received at least one vaccine dose, reported Reuters. Among adults, about 85% have been vaccinated which means that Israel’s vaccinated community is five times larger than its unvaccinated community.
“Countries with high vaccination will see mostly vaccinated people getting ill from COVID,� wrote Arieh Kovler, a political analyst, on Hat Tip.
The people who are not testing positive in the current outbreak are those who have had COVID-19 previously and recovered. These people account for 9% of Israel’s population but less than 1% of recent infections, according to Kovler’s analysis. This has brought new questions about whether natural infections are more protective against the delta variant than vaccinations — but the answer is not yet certain.
In protecting against infection, Pfizer vaccines are 95% effective for the alpha variant but only 64% effective for the delta variant.
In preventing symptomatic COVID-19 cases, Pfizer vaccines are 97% effective for the alpha variant but only 64% effective for the delta variant.
In preventing hospitalization and serious disease, Pfizer vaccines are 97.5% effective for the alpha variant and still 93% effective for the delta variant.

Since the US Food and Drug Administration (FDA) established its accelerated drug approval pathway 28 years ago, more than 2 in 5 drugs granted fast-track approval have not been confirmed clinically effective as required, an in-depth investigation published online today in The BMJ has determined.
"Despite the pathway's good intentions to accelerate 'the availability of drugs that treat serious diseases,' experts are concerned that it is now being exploited — to the detriment of patients, who may be prescribed a drug that offers little benefit and possible harm, and to taxpayers," writes Elisabeth Mahase, clinical reporter at The BMJ, who carried out the analysis.
The BMJ investigation that analyzed data up to the end of 2020 shows that 112 of the 253 (44%) medications granted accelerated approval have not been confirmed to be effective.
In addition, 24 (21%) of these questionable drugs have been on the market for more than 5 years and some have been on the market for more than 20 years — often with a hefty price tag.
Furthermore, only 16 drugs approved through the accelerated approval process have ever been withdrawn and most were shown to be ineffective, but in some cases the confirmatory trials were never done, Mahase reports.
One of the pandemic’s greatest fears was that children, trapped in their homes under stressful conditions, would suffer greater physical abuse with no one there to report it. That worry appears to be well-founded. When schools shut, some of the most common reporters of abuse and neglect, teachers and other district staff, lost their ability to be with children and pick up firsthand on troubling signs. Kevin Mahnken reports on early research findings from a California county indicating that even as abuse-related complaints to social services plunged in the pandemic’s early weeks, the number of children referred for medical examinations at a local abuse clinic increased by 30 percent.

The Biden administration's plans to make covid-19 booster shots available next month has drawn a collective scream of protest from the scientific community.
As some scientists see it, the announcement is rash and based on weak evidence, and they worry it could undercut confidence in vaccines with no clear benefit of controlling the pandemic. Meanwhile, more information is needed on potential side effects or adverse effects from a booster shot, they say.
Perhaps even worse, the announcement has fueled deeper confusion about what Americans need to do to protect themselves from covid.
"I think we've scared people," said Dr. Paul Offit, director of the Vaccine Education Center at Children's Hospital of Philadelphia and an adviser to the National Institutes of Health and the Food and Drug Administration.
"We sent a terrible message," he said. "We just sent a message out there that people who consider themselves fully vaccinated were not fully vaccinated. And that's the wrong message, because you are protected against serious illness."
As of Thursday, 51% of the U.S. population was fully vaccinated, Centers for Disease Control and Prevention data shows. Biden administration officials ― citing data from Israel, a study from the Mayo Clinic that is not yet peer-reviewed and new CDC studies ― say it's necessary to plan for boosters to prevent a worsening of the pandemic as the delta variant powers a surge in cases and overwhelms hospital intensive care units.
The urgent question is whether the vaccines are losing their power against covid.
"We are concerned that this pattern of decline we are seeing will continue in the months ahead, which could lead to reduced protection against severe disease, hospitalization and death," Surgeon General Vivek Murthy said.
