Proposed Legislation is Ultimately Harmful
 

First off, let me say how disappointed I am that this is even a proposal, as there are more important issues to focus on as in funding head start programs, or preventing cuts to Medicaid and Medicare, which really shows how tone deaf this proposed legislation is in regards to the true needs of Virginians.

The petitioner claims that this bill is to "protect" Virginians, particularly women by enforcing the rule of law"biologically female" only to comepete in women's sports. However gender and biology are more nuanced than the XY chromosome.

For example, there is only ONE GENE on the Y chromosome that expresses sex. This gene makes you "genetically male" but isn't an indicator for biological sex. The SRY gene can actually pop off of the Y chromosome and attach to an X chromosome, which means that a Y without SRY means your chromosomally male (XY), but genetically female (XY) and vice versa. An X with SRY means you're physically male but chromsomally female.


What does this mean? It means your chromosomes may be XY but physically you look female (no surgery or HRT needed), or that your chromosomes are XX but physically you look male.

Now how will this proposal account for nuances like this? Or for matters where someone may have an XXY chromosome etc?

Second, this proposal doesn't "protect" Virginians because of how it would have to be enforced. States that have enforced this rule subject girls who are minors to genetalia inspections to determine if they're transgender or not under the guise of a "sports physical." Forced inspection of a minor's genitals is predatory behavior and abuse.

This violates their right to equal protection under the U.S. Constitution, as well as Title IX. I implore that this proposal be rejected so that we can focus on more important things such as funding healthcare, education, and better infrastructure for Virginians.
