The 2022 General Assembly passed SB 187 authorizing the Department of Environmental Quality (DEQ) to accelerate the release of nutrient credits from stream restoration projects notwithstanding release schedules set out in regulation. This guidance seeks to clarify the changes made to § 62.1-44.19:20 of the Code of Virginia and necessary conditions for requesting the accelerated release.

The purpose of this guidance is to revise compliance auditing procedures for unauthorized discharges, overflows and bypasses from facilities covered by a VPDES or VPA permit. Additionally, compliance assessment of overflows from satellite sewage collection systems and unauthorized dry weather discharges from combined sewer systems are included in this guidance. Assessed points are based upon the significance criteria set forth in this guidance. This guidance supersedes Section I.H and Appendix 1 (specifically Section 1.a.v for bypasses and overflows, and Section 4.a for other unauthorized discharges) of the Compliance Auditing Manual (GM#02-2010 and its amendments) and will be incorporated into the Compliance Auditing Manual, Guidance Memorandum No. 02-2010.

This is new guidance that provides information and instructions to DEQ water permitting staff on existing nutrient management plan (NMP) requirements for irrigation reuse of reclaimed water and land treatment of wastewater authorized by Virginia Pollutant Discharge Elimination System permits or Virginia Pollution Abatement permits. The guidance further clarifies the requirements and processes for review and, as applicable, approval of such NMPs, which may additionally involve Nutrient Management Program staff in the Department of Conservation and Recreation, Division of Soil and Water Conservation.
