Construction and Operation of Treatment Works

Gives the State Water Control Board (SWCB) and the Department of Environmental Quality sole authority to regulate the construction and operation of sewage treatment plants, including the review and approval of the plans and specifications for such facilities and transfers the SCAT regulation and program to DEQ. This means that the SWCB will issue the certificates to construct and operate the facility. Transfer SCAT regulations from the Board of Health to the State Water Control Board, possibly through a statutory conformity amendment.
