Propose to modify paragraph L. to recognize only those treatment technologies that underwent a thorough field evaluation in VA prior to the adoption of the ER on 4/7/2010 and GMP 147 on 4/30/2009.  Also, remove the evaluation after 5 years.

Justification: Further comments will be provided on an approval process.  Prior to adoption of the ER and GMP 147, there was a consistent process that was followed to demonstrate that systems would adequately protect the public health and the environment.  Since adoption of ER and GMP 147, no consistent approval process has been applied.

Proposed revised language below:

L. Treatment units for small AOSSs that are recognized by the department as generally approved for TL-2 or TL-3 prior to April 30, 2009 shall retain such status.
