Board Description: The Department administers the Virginia Occupational Safety and Health Program for federal OSHA, the Boiler and Pressure Vessel Safety Program, the Lead and Asbestos Notification and Permit Programs Act for certified lead or asbestos contractors, and the demolition and renovation requirements for asbestos under the NESHAP requirements of the federal Clean Air Act for federal EPA. The regulations for these aforementioned programs of the Department are promulgated by the Safety and Health Codes Board. The Department directly operates the Labor Law Program which enforces the Labor Laws of Virginia and related Departmental regulations. The Department also administers the Registered Apprenticeship Program and the associated regulations which are promulgated by the Virginia Apprenticeship Council. The Department, through its Labor Law Program, is responsible for the administration of the statutes regarding labor, industry, and labor relations, and is authorized to make regulations to carry out the mandates of those statutes. It is also responsible for investigating all complaints for the unlawful withholding of wages, failure to pay the applicable state minimum wage, complaints of violations of the right-to-work law, conciliation and mediation of labor disputes affecting public utilities, and other labor related laws, including investigating and enforcing child labor laws.
