Since more than 180 days have passed since the end of the NOIRA stage, a Time Frame Waiver must be granted by the Governor's office.

Agency Reason: On behalf of the Board of Education, the Department of Education submits the following request to waive the 180 day requirement to submit proposed regulations following the close of the NOIRA public comment period, pursuant to Executive Order 14 (2010). A NOIRA was published December 31, 2012, to amend the Regulations Governing the Employment of Professional Personnel. A comprehensive review of the regulations was planned. The public comment period for the NOIRA ended January 30, 2013. The proposed regulations should have been submitted to DPB by July 29, 2013. The Board reviewed the proposed revisions to the Regulations Governing the Employment of Professional Personnel at its meeting May 23, 2013. The proposed regulations were also shared with the Office of the Attorney General at this time. The Board approved the proposed amendments to the Regulations Governing the Employment of Professional Personnel at its meeting June 27, 2013. The final version of the proposed amendments had been shared with the Office of the Attorney General in advance of the meeting. Upon the Board’s approval, the proposed amendments were submitted to the Office of the Attorney General in the Town Hall system June 27, 2013. The Department and Board’s actions were in compliance with the 180 days requirements; however, the certification by the Office of the Attorney General has taken longer than expected.
