Pursuant to § 2.2-4007.1 E and F of the Code of Virginia, the Department of Rehabilitative Services has conducted a review on 22 VAC 30-30 Provision of Independent Living Rehabilitation Services to determine whether the regulation should be continued without change, amended, or repealed, consistent with the stated objectives of applicable law, to minimize the economic impact of regulations on small businesses.   A public notice of this was review was issued, but no public comment was received by the department. This regulation is needed to govern the provision of independent living services. The regulation has been written to be consistent with the Rehabilitation Act of 1973 as amended and with 34 CFR Part 364, Part 365, and Part 366. This regulation was last reviewed in September 2008. At that time, The State Independent Living Council and directors of Centers for Independent Living reviewed the proposed amendments and indicated the regulation was clearly written and easily understandable. The regulation has no economic impact on small businesses.  Thus, the regulation will be retained as is.
