Small Renewble (Water Related) Energy Projects; DEQ to develop procedure permitting construction and operation - SEE PURPOSE NOTE
Purpose of legislation
[NOTE: Director determination made in 2011 and again in 2014 that no permit by rule was necessary for this type of project at this time. A general notice was posted on determination on 11/6/2014.] Directs the Department of Environmental Quality to develop a permit or permits by rule for the construction and operation of small renewable energy projects that have a maximum capacity of 100 megawatts if they generate electricity from falling water, wave motion, tides, or geothermal power. A small renewable energy project for which such a permit by rule has been issued will be exempt from requirements that the State Corporation Commission permit its construction and operation. However, the Commission will retain jurisdiction regarding use of rights-of-way and interconnection of such facilities. Violations are subject to civil and criminal penalties.
