Title Mandatory Outpatient Treatment Guidance

Summary The 2012 General Assembly established a new procedure which allows certain persons to file a motion requesting a hearing prior to discharge to determine whether a hospitalized individual should be ordered to mandatory outpatient treatment (MOT). The General Assembly also lengthened the maximum period of MOT following discharge to 90 days and changed the conditions under which MOT can be ordered.

Explanation or Citations Mandatory outpatient treatment is governed by ยงยง37.2-805 and 37.2-817 of the Code of Virginia. This document provides CSBs, hospitals and other stakeholder guidance as to how the 2012 changes to the MOT process should be implemented.
