Regulations of the Board of Funeral Directors and Embalmers [18 VAC 65 ‑ 20]
Emergency Extension Request
(3340)
Action:
Identification of human remains
(5622)
Stage:
Emergency/NOIRA

On 7/18/2013 the board requested that this emergency stage be extended until 4/1/2014.

Reason for Extension:
Chapter 377 of the 2010 Acts of the Assembly provided the specific mandate to the Board for adoption of regulations for identification of human remains as a prerequisite for cremation to be effective within 280 days of its enactment. Emergency regulations were submitted on the Regulatory Townhall on 8/3/10 and approved for publication on 9/11/12. They became effective on 10/1/12 and expire on 9/30/13. Proposed regulations were submitted on Townhall on 5/2/13 and are awaiting the Secretary’s and Governor's approval. It is now impossible for the Board to replace the emergency regulations within the statutory deadline of 12 months. Therefore, the Board of Funeral Directors and Embalmers voted at its meeting on July 16, 2013 to request a six-month extension to ensure that regulations for identification of human remains, as mandated by the Code of Virginia, do not expire.

This request expired without being granted.
