Guidance Document Change: The Office of Drinking Water (ODW) is developing technical manuals to replace Working Memos and provide guidance on implementation of the Virginia Waterworks Regulations and drinking water program. The Enforcement Manual provides consolidated guidance on the procedures administered by ODW, as authorized in Title 32.1 of the Code of Virginia, the Public Water Supplies Law, Code of Virginia §§ 32.1-167 through 32.1-176, and the Waterworks Regulations, 12VAC5-590-10 et seq. It does not replace the requirements of state law or regulations. It includes updates to previous guidance related to ODW’s enforcement program and procedures for prioritizing violations based on the potential harm to human health and for elevating ODW’s enforcement response to ensure consistency with the federal enforcement response policy. The Enforcement Manual also includes new procedures for assessing civil charges for noncompliance and issuing administrative orders by consent or as the result of an informal hearing. The Enforcement Manual replaces three Working Memos that are not currently in effect: 453 (Enforcement), 529 (Water – Procedure – Enforcement), and 764 (Water – Procedure – Enforc Acts, Orders, Court, Log Rev, - Phase II/V Notice of Violation and Informational Notices).
