Guidance Document Change: The Model Policies for the Treatment of Transgender Students in Virginia’s Public Schools guidance document was developed in response to House Bill 145 and Senate Bill 161, enacted by the 2020 Virginia General Assembly, which directed the Virginia Department of Education to develop and make available to each school board model policies concerning the treatment of transgender students in public elementary and secondary schools. These guidelines address common issues regarding transgender students in accordance with evidence-based best practices and include information, guidance, procedures, and standards relating to: compliance with applicable nondiscrimination laws; maintenance of a safe and supportive learning environment free from discrimination and harassment for all students; prevention of and response to bullying and harassment; maintenance of student records; identification of students; protection of student privacy and the confidentiality of sensitive information; enforcement of sex-based dress codes; and student participation in sex-specific school activities, events, and use of school facilities.

Strongly opposed to proposed policy
 

 

In reviewing the proposed policies regarding transgender students, we have several concerns: 

  1.  Nowhere in the document does it enumerate the percentage of supposed transgender students vs. the percentage of supposed cisgender students.         
  2. It is stated in the proposed policy that neither a student of school employee may challenge the status of a student.  How would the Board propose to address the feelings or protect the safety of a female student should a transgender female wish to use the female locker room / bathroom?
  3. Nowhere in the document does the Board address the potential cost of addressing potential privacy concerns presented by these policy changes.  Will the state bear these expenses or will this be left up to the localities?
  4. Although it is stated that athletic competition is not addressed in these policies, surely the VHSL will be under extreme pressure to conform to these changes at a later date.  We feel that transgender females being allowed to compete with the girls would be an extreme injustice and potentially present a dangerous environment for the girls.
  5. In reviewing the personnel makeup of the committee, it appears that there is a great lack of parental involvement.
  6. In the event that these changes are adopted, what is the vehicle for reversing these changes should they prove detrimental to the student population as a whole?

 

In summary, we believe that these changes are an invasion of the privacy of the vast majority of cisgender students and in the long run, would be detrimental to the education of all students.
