Landowner Permission and Notification:

 

--States that have addressed this issue have found that the system is rife with problems. Even the most liberal states have resorted to a registry of those wishing to be notified in the event of an application on adjoining or nearby property. These registries have attracted few registrants…especially even if a small fee is charged to register.

 

--Urban areas pose a problem in that 101 Pine Street's back yard may abutt  the backyard of102 Maple Street however there is no easy way to tell if this is the case.

 

-- Bottom line…notification sounds reasonable at first blush but with any degree of scrutiny it becomes obvious that the "cure is worse than the kill".
