This action is exempt from the executive branch review process.
The regulation is essential to enabling the agency to efficiently and economically accomplish the important governmental function of managing wildlife populations and recreational or commercial uses thereof to control impacts to the health, safety, and welfare of the people of Virginia. The regulation ensures that citizens wishing to participate in the sport of falconry may be authorized to do so in accordance with federal requirements. The health and safety of agribusiness and the people of Virginia are protected through the monitoring, inspection, and requirements pertaining to taking, possessing, and transfer of resident and exotic raptors used in the sport.

Federal Authority Title 50 CFR, Part 21, Migratory Bird Permits, Sections 21.28 and 21.29 require "joint concurrence" by the state prior to Falconry Permits being issued by the U.S. Fish and Wildlife Service for the sport of falconry.
Exempt from APA Yes, changes to this chapter of the VA Administrative Code are exempt from the Administrative Process Act. The normal executive branch review process is not required.
