| Action Summary |
This Fast Track regulatory action amends two existing regulatory chapters - the Rules and Regulations Governing Health Data Reporting (12VAC5-215) and the Methodology to Measure the Efficiency and Productivity of Health Care Institutions (12VAC5-216). These chapters govern the collection and reporting of financial and operational data submitted by health care providers used to evaluate the Commonwealth’s medical care facilities. The intent of the proposed changes is to (i) clarify the current practices associated with the reporting of financial and operation data by health care providers; (ii) align the Regulations with current practices conducted by medical care facilities when collecting and reporting patient level health data, and those conducted by the nonprofit organization when measuring the efficiency and productivity of medical care facilities; (iii) make the Regulations easier to read and understand by conforming provisions to the Form and Style Guidelines published by the Virginia Registrar of Regulations; and (iv) update the Regulations to meet the objectives of Executive Order 19. The Regulations were last amended in 1996 (Chapter 215) and 1997 (Chapter 216), respectively.
This fast-track action combines two existing regulatory chapters (12VAC5-215 & 12VAC5-216) into a single chapter and reorganizes regulatory content that results in greater clarity of the requirements and practices related to the submission of financial and operational data used to evaluate the efficiency and productivity of the Commonwealth’s medical care facilities. Chapter 216 is repealed under this regulatory action, and relevant provisions have been incorporated into Chapter 215 to specify the filing requirements associated with and applicable to medical care facilities, due dates, fee structures, utilization data, and financial information that is periodically published and used to measure the efficiency and productivity of medical care facilities. Several sections within Chapter 215 have been repealed and applicable provisions have been amended and/or relocated to new sections within the amended regulatory chapter. Outdated definitions have been removed, and new definitions have been added to make the provisions clearer and easier to understand.
