Description of Proposed Guidance Document Changes

The existing APG-200A - Title V Air Permits Guidance Manual was originally released in 1999 by the Virginia Department of Environmental Quality (DEQ) Office of Air Permit Programs (OAPP) and has been updated periodically. The OAPP is in the process of reviewing each chapter of the existing manual and updating as appropriate. Chapter 1 and Chapter 5 have been updated for the Title V Manual. Chapter 1: This chapter was updated and is related to determining when a stationary source is / becomes subject to the Title V requirements of the federal Clean Air Act and Article 1 of the Commonwealth of Virginia State Air Pollution Control Board Regulations for the Control and Abatement of Air Pollution, 9VAC5 Chapter 80. The changes made include: 1) Removed discussion of federal verses state definition of major source; 2) Removed discussion of source being major on basis of greenhouse gas emissions; 3) Removed discussion of state operating permits (SOP) and minor new source review permits regarding synthetic minor status and moved them to Chapter 11 in May 2018; and 4) Removed discussion of exclusionary general permits. Chapter 5: The document was updated related to the development of a Statement of Basis (SOB) as required by the federal Clean Air Act and 9VAC5-80-150. The SOB is a document that accompanies a Title V permit that sets forth the legal and factual basis for Title V permit conditions. The referenced SOB Boilerplate is also attached to this chapter. The changes made include: 1) Revised section headings. 2) Provided more discussion of the purpose and scope of SOB. 3) Reorganized sections of SOB content to be in sync with the SOB boilerplate document. 4) Expanded on the handling of confidential information. 5) Reduced discussion of public participation as there is a chapter devoted to this topic. 6) Added section to encourage permit writer to consider certain points when finalizing SOB.
