Description of Proposed Guidance Document Changes
DPOR has previously posted to Virginia Regulatory Town Hall many agency policies. This document is included in the agency’s listing of guidance documents. This document pertains to DPOR and its operations generally and is not regulatory in nature. This action will make amendments to the following guidance document on Virginia Regulatory Town Hall: Policy #800-02: Filing of Complaints Against Regulants. The policy establishes DPOR guidelines for receiving complaints filed against regulants. The following changes are made to the policy: a. Formatting of the document is changed. b. Provisions of the policy pertaining to exceptions from the requirement that all complaints be in writing are revised as follows: i. The exemption related to hardship is revised to provide that a hardship be as contemplated by the Americans with Disabilities Act. ii. The exemption related to life-threatening situations or situations that have resulted in, or have the potential to result in, harm, personal injury or loss to a consumer or the public is revised to provide that life threatening situations or situations that have resulted, or have the potential to result in, physical harm or personal injury to a consumer or the public are exempt from the written complaint requirement. iii. An exemption for situations resulting in the loss of the consumer’s residence rendering the consumer unable to submit a written complaint has been added.
