Description of Proposed Guidance Document Changes
In accordance with the Real Estate Board’s regulations, individuals applying for licensure are required to disclose any criminal convictions at the time of their application, with certain convictions subject to additional review by the Board. The Real Estate Board Application Review Matrix Guidance Document has been updated to streamline the application process for applicants with criminal convictions. Key updates include the addition of "embezzlement" to the list of convictions that will be subject to review by the Board to ensure the protection of public health, safety, and welfare. The section addressing misdemeanor convictions has been revised to clarify that the Board will only consider reportable convictions within the past three years if the applicant has a prior conviction of the same offense within the last five years. Additionally, the section concerning felony drug convictions has been updated to specify that the Board will only review convictions within the past five years and will require proof of substance abuse counseling only if mandated by the court. These changes are designed to reduce the burden on applicants with criminal convictions and decrease the number of applications requiring further review by the Board.
