Description of Proposed Guidance Document Changes
As a result of action by the 2022 General Assembly, localities that are subject to the Chesapeake Bay Preservation Act (Va. Code §62.1-44.15:67-79), are required to publish the elements and criteria adopted to implement their local plan, including those elements and criteria required by 9VAC25-830-60 on their website. DEQ has developed implementation guidance intended to assist localities subject to the Chesapeake Bay Preservation Act in adhering to the requirements of Va. Code § 62.1-44.15:67(C), which requires localities subject to the Bay Act to publish on its website the elements and criteria adopted to implement their local plan. DEQ also accepted and considered comments on the guidance during an informal comment period from September 6, 2022, through October 21, 2022.
