Description of Proposed Guidance Document Changes

The 2021 revision of the Guidelines for the Management of Individuals Found Not Guilty by Reason of Insanity (NGRI Manual) includes modifications to the procedures used by the Department of Behavioral Health and Developmental Services for the clinical and administrative management of individuals who have been committed by the courts of the Commonwealth to the custody of the DBHDS as a result of a judicial finding of Not Guilty Reason of Insanity (NGRI), pursuant to the provisions of Chapter 11.1 of Title 19.2 of the Code of Virginia. The 2021 edition of the NGRI Manual updates the policy and procedural changes that have been implemented following the issuance of the 2003 NGRI Manual. The draft changes: update relevant citations for the Code of Virginia, the name of the Department; include a section on the use of a standardized structured clinical judgment instrument to assist with the assessment of risk; support individualized recovery by allowing the bundling of privileges to the extent that the bundled privileges continue to require adherence to the demonstration model used in the management of NGRI acquittees; update the procedures during temporary custody that allow commitment to the temporary custody of the commissioner to occur on an outpatient basis; expand the response options for acquittees who abscond from custody, or are otherwise unaccounted for during the exercise of passes; expand victim notification procedures to include notification at the time of discharge as required by the Code of Virginia; expands conditions of release to include requirements that may be imposed by probation/parole or other law enforcement entities.
