Mandate Title:
Stormwater management; use of a proprietary best management practice
Purpose of legislation
Requires for the use of proprietary best management practices (BMPs), also known as Manufactured Treatment Devices (MTDs), only if another state, regional, or national certification program has verified and certified the MTD’s nutrient or sediment removal effectiveness. The bill further provides that any MTD included on the Virginia Stormwater BMP Clearinghouse prior to July 1, 2020 shall provide documentation to the Department of Environmental Quality (DEQ) by December 31, 2021 showing that another state, regional, or national certification program has verified and certified its nutrient or sediment removal effectiveness. Finally, the bill provides that any MTD that fails to provide DEQ with this documentation shall not be approved for use in any stormwater management plan submitted on or after January 1, 2022 until such documentation is provided to DEQ.
