The agency has conceded that there are no criteria for privately operated DMV select locations in communications with the undersigned.  The public procurement act at Va. Code Sec 2.2-4300 states that the purpose of the act is that "all procurement procedures be conducted in a fair and impartial manner"...that "all qualified vendors have access to public business and that no offeror be arbitrarily or capriciously excluded"...  Va. Code 2.2-4305 says in part that "all public contracts with nongovernmental contractors...for the purchase of services...shall be awarded after competitive sealed bidding or competitive negotiation"...  Currently there is no process.  The DMV should establish all areas where DMV select locations are necessary or possible and then issue requests for proposals for those locations and additionally require the current private DMV select operators to competitively bid periodically as required by law.
