We request that you favorably consider the proposed change below:

6. A kitchen in a private home, such as, but not limited to, a family day-care provider or a home for adults, serving 12 or fewer recipients; or a bed-and-breakfast operation that prepares and offers food only to guests if the premises of the home is owner or owner-agent occupied, the number of available guest bedrooms does not exceed six, breakfast is the only meal offered, the number of guests served does not exceed 18, and the consumer is informed by statements contained in published advertisements, mailed brochures, and placards posted at the registration area that the food is prepared in a kitchen that is, by these regulations, exempt from this chapter;...

This change simply recognizes that many Virginia B&Bs have more than 6 rooms and hence more than 12 people to whom they serve breakfast on any one day, and sets a reasonable upper limit on the number that can be served without requiring a full restaurant license.  B&Bs are not restaurants and preparing and serving breakfast does not require restaurant level equipment nor should they be subject to the regulations for a full service restaurant that serves the general public for several meals a day.
