The landmark U.S. Supreme Court decision in Olmstead v. L.C. (decided on June 22, 1999) established that unjustified segregation and institutionalization of people with disabilities constitutes illegal discrimination under Title II of the Americans with Disabilities Act (ADA). My brother is intellectually disabled, (ID) and unfortunately he has been abused in institutions as well as group homes. It is a blessing because I was finally able to obtain the State Rental Assistance Program (SRAP) for him so now he lives in his own home with a live-in, most importantly, the CL waiver is giving him a substantial amount of hours which pays for the hours of care he needs. If his hours are cut back or if he is no longer able to have live-in assistance, my brother cannot live on his own and would have to return to a group home where too often abuse runs rampant. My brother is one of millions. I ask on behalf of all mentally disabled individuals that availability to service hours are not reduced or soft capped and live-in arrangements are not changed. It's not their fault that they have a mental disability, these individuals did not commit a crime. Limiting their service hours and live-in capabilities will give them a life sentence to institutions and group homes where too often abuse runs rampant. You wouldn't want that for yourself or for your loved ones. Please keep this in mind and keep things status quo.
