Proposed 8VAC20-781-250(J) requires that "sandboxes shall be covered while not in use." This is problematic for at least two reasons. First, what does "not in use" mean? Does it mean times that the facility is closed (such as overnight), or does it mean any time that there is no child in the sandbox? Second, this proposed regulation is impractical for facilities with large sandboxes; some are simply too big to cover.
