EOR can't be a LRI
 

Stating the EOR cannot be an LRI if another LRI is an attendant is not acceptable.  I am noted as my son's primary caregiver under Medicaid, and I am also the EOR.  I chose consumer directed so that I would decide what attendants would be in my home with my son who has very limited communication and multiple challenges.  When the pandemic hit and Appendix K happened, my husband, who is also our son's father, became the attendant for our son.  I would never want to move over to agency directed, because if we ever needed an additional attendants we would have no control on who was sent to us.  For our son with limited communication and other challenging factors, this is not possible.  Enabling my husband to stay under consumer directed is great, but not if I can no longer be the EOR.  My husband works in Virginia.  Our families live between 300-450 miles away.  We have NOBODY within 50 miles we can ask to be the EOR - someone who will see our son's personal information, who will decide who can an cannot be an attendant for our son, and who will be expected to track everything.  So, you'd leave us with finding someone we barely know who is willing to track all of this, hire, monitor, etc for ZERO pay, or we'd have to find an attendant who is willing to work for very little pay, and who I can NEVER leave alone with my son due to his very minimal communication and the other challenging factors that are too personal to mention here.  This waiver is supposed to help those with disabilities, not make things worse for them and for their families.  Whomever came up with this EOR rule must not have disabled children on any waiver, because I can't imagine anyone living this life thinking that this rule would be ok.  Please allow a parent to continue to be the EOR if the other parent is an attendant.
