A mandate violates the Department of Education Organization Act
 

The United States Congress has specifically stated, as a founding principle of the U.S. Department of Education, that "The Congress finds that …parents have the primary responsibility for the education of their children, the States, localities, and private institutions have the primary responsibility for supporting that parental role; ...". (Department of Education Organization Act, Pub. L. 96-88, Title I, §101, Oct. 17, 1979, 93 Stat. 669, codified in 20 U.S.C. §3401[3]).

 

“States, localities, and private institutions” have the legal, primary responsibility to support the parental role, which includes the Virginia Department of Health. To define parental role according to the Office of the Attorney General’s VirginiaRules.org website on the VaRules Topics page, it states, “Your parents have the right to “custody and control” of you. Custody and control means you must obey your parents unless they ask you to break the law, and they must take care of you. …Parents must provide you with necessary food, clothing, shelter, and medical care as well as supervision, discipline, protection, and education.” It goes on to include, “You have the legal responsibility to follow your parents’ rules and go along with their decisions.” This clearly states it is the parent’s role and obligation to provide medical care, and children have the legal responsibility to follow their parent’s decisions, which includes medical decisions.
