7.2: SPONSORED RESIDENTIAL

  • Customized rate funding approved for Sponsored Residential Supports cannot be used to increase the sponsor payment directly.  

  • Funding approved shall only be used to pay for and provide additional staff, not including the sponsor(s), who are necessary to provide the 1:1 or 2:1 supports required to ensure the health and safety of a qualifying individual.  

 

  • Families, caregivers or other individuals who maintain full time residential status in the home where the
    qualifying individual is receiving services, shall not be included in the customized rate request for additional 1:1 or 2:1 staffing.  

  • Families or caregivers acting as the sponsor are required to provide a minimum of 40 hours weekly of support to the individual before customized rate funding can be approved to cover the cost of paying for or hiring additional staff.

  • Eligible providers must indicate that they have met financial thresholds as outlined in the sponsored residential rate model for paid staff, not including the sponsor.  

The proposed language within section 7.2 related to Sponsored Residential and Customized Rates contradicts itself and makes incorrect assumptions about the requirements of anyone living in the home of a Sponsored Residential Provider. Sponsored Residential Services do not require that a Sponsor be married or have another person who lives in the home that is not receiving services. Other adults who live in the home may work in jobs outside of the home and the Sponsored Service. They may not have any additional training and only have their backgrounds completed.

Adults, other than the identified Sponsor, living in the home must be counted separately in the customized rate application if they choose to work in the home and are hired and trained by the identified Sponsor to provide DSP Services. This would include spouses, significant others, adult children of the sponsor or hired adults who live in the home and are trained to provide DSP Services within the setting. The criteria within this section forces the committee to count 2 or more people providing services and living in the home as one person within the Customized Rate Model. This proposed guidance could discount hundreds of hours of work being provided by other Direct Support Professionals living in the setting.

If a Direct Support Professional is hired, trained and paid by the identified Sponsor then the hours worked by the DSP should be counted toward the customized rate regardless of where they live or any other status they may hold such as spouse, significant other, adult child or live-in DSP. This would not be increasing the identified or contracted Sponsored Provider payment or 40 hours, simply recognizing the staff necessary to provide the service who are hired, trained and paid by the sponsor/host.

Section 7.1

This section needs clarity. It reads as if Residential Provider A receives a CR for providing services to an individual, that the same individual can no longer receive services from CE/CC Provider B because of the addition of the language “and reimbursed” in the last sentence of this section. This is not believed to be the intent, but unfortunately this is unclear. An individual should be able to receive CE/CC or Group Day Services whether or not a Residential Provider is approved for CR.  

Acceptable Degrees are listed in section 6.4. In multiple places throughout the document, it is stated the degree list is in Section 6.3.

Customized Rate Guidance Comment
 

Section 7.2 contains substantial changes for Sponsored Residential programs. Section 7.2 will make it next to impossible for anyone to receive customized rates within Sponsored Residential programs. It only recognizes 1 person in the home as being the one providing services. The proposed guidance will discount many hours of work that could be provided by backup workers who live in the home as relatives of the provider.  ALL backup workers are trained professionals who can be of great benefit during times when it is most difficult to obtain well trained professionals. These services make the difference for people who are receiving services  as they cannot have someone who is the family they but will not be considered or recognized within the customized rates framework.  It is a benefit to the individuals  to have familiar staff, they can count on who know them and care about them. Not being able to pay for more than 1 person limits what care can be obtained as people need need to be able to work for pay. It is more difficult than ever to find people who are willing to work part time, evenings, weekends or holidays.

To whom it may concern, from what I gather from this "Suggestion" you want to only pay the DSP who is not living in the home. This is not possible. I am lucky enough to have the staff that I have on hire now. No one wants to work, and you cannot trust just anyone to come into your home and be of assistance to these patients. The amount of training and learning that goes into this job is beyond what is provided from programs taken to get hired to work in a home. The provider is the one who takes her time to train and coach on doing daily work, endless reports that have to be done after and on each shift. The provider is the one who knows the most about each individual as they are the ones who live with them. That is to only name a few instances where their time comes into play. Having sponsored residential offered to these patients is much better than them being in an institution. They have much more freedom with providers and DSP's on shift. Without the time put in by individual providers, DSP workers will not be able to learn and grow with this industry. The providers, such as myself , work endless hours in this industry and now my hours could possibly not reflect my pay? I have opened my home up to this service, as my choice but my time should still be compensated for. I hope you take into consideration all of this as well as what others have suggested.

In section 7.2 of the guidance document under sponsored residential there are changes I would ask you to reconsider.  The customized rate being considered when 2 or more people living in the home and providing service only counted as one person would result in 100's of discounted hours.  All staff who are hired and trained and paid as a DSP providing service should be considered toward the customized rate no matter where they live or their relationship.

Good Morning,

My name is Marietta Cottingham. I am one of the Assistant Executive Directors of Serenity C&C, Inc. in Tidewater, and Central Virginia. Our company provides Sponsored Residential Support to approximately one hundred-ten adults and children   We also provide Day Support to approximately 25 individuals, Community Engagement to about 45 individuals, Out of Home Crisis Intervention, Children’s Respite Services and Applied Behavior Analysis (25 children). 

We have approximately 100 contractors and 75 staff.

This morning I want to comment briefly to tell you what I see as a problem with the Proposed Customized Rates and the effects they will have on Sponsored Residential Support Providers and the individuals they support 24 hours daily, seven days a week.  This proposal is prejudicial and counterproductive. It exacerbates the current shortages of available Direct Support Professionals.

In Section 7.2 of the Guidance Document for the Public Comment Forum the reader will find five bullet points relating to pay for staff needed to provide the additional care and support for some persons receiving support in Sponsored Residential Homes.

Taken together the five points seem to have been devised to make sure no Sponsored Residential Provider would benefit financially from the customized rate rather than to assure that appropriate support and care would be available to ensure the health and safety of the person receiving services with exceptional needs.

The five points are focused much more on disqualifying persons who reside in the Sponsored Residential Home than on making the best possible support available.  The spouse, child, sibling or other acquaintance of the Sponsored Provider, living in the home, cannot be hired to provide customized support regardless of that person’s qualifications, ability, willingness or desire to do so.  But someone else who might have less qualifications, experience, and awareness of the wants and needs of the person receiving services can be hired.  A situation like this might not happen often but it does not need to be possible at all.

An adult child or spouse of a sponsored provider might have a long-standing empathetic friendship with the person receiving services.  The adult child or spouse may be fully qualified and trained and experienced in all the aspects of providing residential support.   The adult child or spouse may be the person most preferred by the person receiving services.  If this adult child or spouse lives in the residential home, he or she cannot be hired to provide additional support. But if this same person lives elsewhere, he or she can be hired.  Why is this prejudicial restriction applied to this situation?  Are we not always told to provide the best support available?  Are we not expected to honor the individual’s choice of support provider?

Finally, this is a time when it is almost impossible to hire and retain proficient Direct Support Professionals.  There is a major shortage of people to provide this essential service, yet we have here a proposal to exclude many persons who have the desire, the ability, the experience, and the potential to provide exceptional support to persons who need and have the right to excellent support.  These proposals have the potential to seriously jeopardize the health and safety of individuals with the greatest needs.

Remove the biased restrictions that are included in section 7.2 of the Proposed Customized Rate.

Customized Rate Guidance Document - Substantial Changes for Sponsored Residential
 

Section 7.2:  for Sponsored Residential contains substantial changes and will make it extremely difficult for anyone in a Sponsored Service to receive the Customized Rate.   The criteria within this section forces the committee to count 2 or more people providing services and living in the home as one person within the Customized Rate Model. This proposed guidance could discount hundreds hours of work being provided by other Direct Support Professionals living in the setting.

 

If a Direct Support Professional is hired, trained and paid by the identified Sponsor then the hours worked by the DSP should be counted toward the customized rate regardless of where they live or any other status they may hold such as spouse, significant other, adult child or live-in DSP. You must recognize all staff necessary to provide the service who are hired, trained and paid by the identified sponsor/host.

 

Here is what section 7.2 says to provide you with a frame of reference:

 

 

 

7.2: SPONSORED RESIDENTIAL

 

 

Customized rate funding approved for Sponsored Residential Supports cannot be used to increase the sponsor payment directly. 

 

Funding approved shall only be used to pay for and provide additional staff, not including the sponsor(s),who are necessary to provide the 1:1 or 2:1 supports required to ensure the health and safety of a qualifying individual.

 

 

Families, caregivers or other individuals who maintain full time residential status in the home where the

qualifying individual is receiving services, shall not be included in the customized rate request for additional 1:1 or 2:1 staffing. 

 

Families or caregivers acting as the sponsor are required to provide a minimum of 40 hours weekly of support to the individual before customized rate funding can be approved to cover the cost of paying for or hiring additional staff.

 

Eligible providers must indicate that they have met financial thresholds as outlined in the sponsored residential rate model for paid staff, not including the sponsor.
