Action Summary | The State Council of Higher Education for Virginia (SCHEV) has prepared a comprehensive set of amendments to Virginia Administrative Code (VAC) Chapter 31, Sections 10 to 320, which comprehend SCHEV’s responsibility to regulate private and out of state postsecondary education in Virginia. SCHEV’s authority to promulgate regulations to carry out this duty is provided in Virginia Code §23.1-215. The amendments to Chapter 31 include reduction of discretionary requirements and modifications to the remaining requirements that simplify, streamline, and update each section of the chapter. In response to Governor Youngkin’s Executive Order 19 (EO19), which established the Office of Regulatory Management (ORM) to create a process for “implementing a 25% reduction in regulatory requirements” by Virginia state agencies, SCHEV staff initially identified 433 discretionary requirements, which constitute the baseline against which the 25% reduction target must be achieved. This proposal eliminates 150 of those requirements, producing a net reduction of 34.6%. |
