Since more than 180 days have passed since the end of the NOIRA stage, a Time Frame Waiver must be granted by the Governor's office.

Agency Reason: On behalf of the Board of Education, the Department of Education submits the following request to waive the 180 day requirement to submit proposed regulations following the close of the NOIRA public comment period, pursuant to Executive Order 14 (2010). A NOIRA was published August 26, 2013, to amend the Procedure for Adjusting Grievances. The public comment period for the NOIRA ended September 25, 2013. The proposed regulations should have been submitted to DPB by March 24, 2014. The Board first reviewed the proposed revisions to the Procedure for Adjusting Grievances at its meeting January 16, 2014. The proposed regulations were also shared with the Office of the Attorney General at this time. The Board approved the proposed amendments to the Procedure for Adjusting Grievances at its meeting February 27, 2014. Upon the Board’s approval, the proposed amendments were submitted to the Office of the Attorney General March 18, 2014. The Department and Board’s actions were in compliance with the 180 days requirements; however, on May 1, 2014 the Office of the Attorney General requested several edits to align the proposed regulations with changes in the Code enacted by the 2014 General Assembly. The agency made the requested changes and resubmitted the regulations to the Office of the Attorney General June 4, 2014.

The request was removed from the Gov’s pending list and information about missed time frame deadline will now be included in the agency’s annual report about such events
