Since more than 180 days have passed since the end of the NOIRA stage, a Time Frame Waiver must be granted by the Governor's office.

This waiver was requested on 11/27/2012

Agency Reason: During the public comment period, the language submitted with the NOIRA was found to be un-workable and excessively restrictive to the jails. The Board of Corrections appointed a committee to work with the coalition of entities requesting the regulation and representatives from the Virginia Sheriff Association and the Virginia Association of Regional Jails to develop new language to meet the regulatory need without imposing undue burden on the jails. This committee met repeatedly over a period of months to develop the new regulatory language included with the Proposed stage of this Action. The Proposed stage has been submitted in a timely manner after Board of Corrections approval of the regulatory language and the Board Motion to move to the Proposed stage.
