The Auctioneers Board has proposed changes to its regulations with the goal of providing additional clarity and to “modify sections relating to disciplinary actions.” The proposal, however, is overly broad and may be adverse to the customers it purports to help, primarily because the language does not clearly indicate whether the Board may permit the collection of moneys owed not directly related to the service being requested, provided, delayed, or denied. This discretion could both coerce licensees into paying contestable fines and fees and enable the Board to deny any service rather than those just related to licensure. Accordingly, the proposed regulatory action modifying the regulations of the Virginia Auctioneers Board, 18 VAC 25-21, is rejected.
