I am approving this regulation with the notation from the Chief of Staff: "I have reviewed and reluctantly approved this regulation for publication on a preliminary basis only because the law mandates that the agency promulgate regulations. I encourage the public to comment on the need for the government of the Commonwealth of Virginia to intrude in the regulation of the removal of body hair from its citizenry. There has been no documentation during the promulgation of this regulation demonstrating the rationale for picking 600 hours as the training level for estheticians other than "this is what everyone else does". The regulation also fails to demonstrate why estheticians that have been working for three or more years (the grandfathering provisions) provides for the public safety rationale purported to be at the heart of this law and therefore this regulation."
