This guidance document is intended to assist local education agency (LEA) personnel as they work to address the needs of their students who have been identified as, or are suspected to be, students with disabilities
in Virginia. The Individuals with Disabilities Education Improvement Act (IDEA 2004) implementing regulations, at 34 C.F.R. ยง300.503 and the Regulations Governing Special Education Programs for Children with Disabilities in Virginia (Virginia Regulations), at 8 VAC 20-81-170.C, provide the regulatory requirements which will be addressed in this document. Information contained in this guidance document is intended to address these regulatory requirements and provide best practices to ensure compliance with the provision of prior written notice as required under these regulations. |
