Title Guidelines for the Management of Individuals Found Not Guilty By Reason of Insanity

Summary This document defines the operational policy of the Department of Behavioral Health and Developmental Services, with regard to the management of individuals referred for treatment, pursuant to Chapter 11.1 of Title 19.2 of the Code of Virginia. The Guidelines include an overview of the statutory basis for the finding of Not Guilty by Reason of Insanity (NGRI) in the Commonwealth, and provides specific instructions for use by facility staff and community services board personnel. (REVISED 2/7/23 for a one-word correction.)
