Regulations Governing the Practice of Pharmacy [18 VAC 110 ‑ 20]
Emergency Extension Request
(5861)
Action:
Implementation of 2021 legislation for pharmacists initiating treatment
(9452)
Stage:
Emergency/NOIRA

On 3/6/2023 the board requested that this emergency stage be extended until 12/20/2023.

Reason for Extension:
Chapter 214 of the 2021 Acts of Assembly required the Board of Pharmacy to promulgate emergency regulations regarding pharmacists initiating treatment, building on legislation from the 2020 session allowing pharmacists to initiate treatment. Emergency regulations became effective on December 22, 2021 and are currently set to expire on June 21, 2023. The Board submitted proposed regulations to replace the emergency regulations on March 21, 2022. Those regulations were approved by the Governor in late October and published by the Registrar in November. The required comment period closed on January 20, 2023. The next Board meeting following the close of the comment period is March 30, 2023. The Board will act on final regulations at that time. However, due to the need for publication in the Register and a final comment period, it is not possible for the regulations to be effective prior to June 21, 2023. The agency requests a six-month extension of the emergency regulations to ensure public health service coverage for diseases and conditions addressed by the 2021 law.

This emergency extension request was approved by the Governor's office on 3/15/2023.
